The deal, in writing
These Terms & Conditions are the agreement between you and Team Love Taco LLC when you use our website, join the Taco Ride Stash, receive our messages, or take part in the Thursday Taco Ride. Please read the risk, SMS, and liability sections carefully.
01 Agreement to these terms
By accessing the teamlovetaco.com website, creating an account, opting into our texts or emails, buying merch, or participating in the Thursday Taco Ride, you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use the site or the services.
02 Who can use the site
You must be at least 13 to create an account and 18 or older to opt into "spicy" content or to attest to age-gated features. The ride is positioned as an adult event; the Wabash Trace is a public trail, and nothing here bars anyone from a public trail, but the crowd and vibe are grown-up. You are responsible for keeping your account credentials secure and for activity under your account.
03 About us & affiliate disclosure
Team Love Taco LLC is an independent business and an affiliate marketer for SWINT and Tobey Jack's Mineola Steakhouse. We may earn a fee — for example, a per-validated-rider referral fee from Tobey Jack's — when riders we refer visit our partners. This is standard affiliate marketing; our opinions and content are our own.
SWINT and Tobey Jack's are separate companies. They are not responsible for this website, our messages, the Taco Ride Stash, or the ride itself, and they make no representations or warranties through us. Any dealings you have directly with a partner (including your visit to Tobey Jack's) are between you and that partner.
04 The ride — assumption of risk & release
Cycling has real risks. The Thursday Taco Ride takes place on a public trail and public roads. Weather, trail conditions, other trail users, wildlife, and your own equipment and choices can all cause injury. You ride entirely at your own risk.
You are responsible for yourself. You are responsible for your own safety, fitness, equipment, lights, helmet, following all trail and traffic rules, and for riding sober and in control. Ride status and weather information we publish are informational only and are never a guarantee that conditions are safe.
Release. To the fullest extent permitted by law, you assume all risks of participating and release, waive, and agree not to sue Team Love Taco LLC, SWINT, Tobey Jack's, and their owners, members, volunteers, and organizers for any injury, loss, or damage arising out of your participation in or travel to and from the ride. This is a public trail; we do not own, control, or supervise it.
05 Accounts & the Taco Ride Stash
The Taco Ride Stash is a free, for-fun rewards game. Points, badges, streaks, tiers, and leaderboard standings have no cash value, are not property, cannot be bought, sold, or transferred, and may be adjusted, expired, or reset under the published game rules (for example, streak resets after missed rides). We may correct errors, remove fraudulent activity, and suspend or close accounts that abuse the program.
Referrals: referral credit vests only when a referred rider completes the published vesting requirement. We may withhold or reverse credit for gaming, fake accounts, or abuse. We reserve the right to change or end the program, badges, or rewards at any time.
06 Tobey Jack's validation & receipts
When you scan a checkpoint or upload a receipt to validate a Tobey Jack's visit, you confirm the information is truthful and the receipt is genuine and your own to submit. Each check number can be used once. Submitting fraudulent, altered, shared, or reused receipts is prohibited and may result in loss of rewards and account closure. Validation and points are subject to our review, time-gating, and anti-fraud rules, and are not guaranteed.
07 Text message (SMS) program terms
Program: Team Love Taco Ride Coordination. By opting in, you agree to receive recurring, non-marketing coordination and update texts from Team Love Taco at the number you provided, sent via an automated system. Consent is not a condition of any purchase.
Frequency & cost: Message frequency varies by ride week. Message and data rates may apply. Check with your carrier for details.
Opt out & help: Reply STOP to cancel at any time; you'll get one confirmation and no further messages. Reply HELP (or INFO/SUPPORT) for help, or contact info@teamlovetaco.com.
Carriers: Mobile carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.
Privacy: We will not sell or share your mobile number or SMS opt-in with third parties for their marketing. See our Privacy Policy — SMS section for full details.
08 Email program terms
By opting into email, you agree to receive ride reminders, recaps, and updates. You can unsubscribe from marketing email at any time using the link in any message; we may still send essential account and transaction messages.
09 Merch & orders
Merch is sold through Shopify and fulfilled by our print partner. Your purchase, payment, checkout, and any refunds or shipping are handled under Shopify's and the fulfiller's terms. Prices, availability, and products may change. We are not responsible for third-party payment processing or fulfillment errors beyond our reasonable control.
10 User content & sticker walls
If you post content — a trail name, comments, sticker-wall placements, or anything else — you confirm you have the right to share it and that it isn't unlawful, infringing, or abusive. You grant Team Love Taco a non-exclusive, royalty-free, worldwide license to display and use that content to operate and promote the program. We may remove any content and reactively moderate placements at our discretion.
11 Intellectual property
The Team Love Taco name, logos, taco mascots, badge art, sticker designs, copy, and site design are owned by Team Love Taco LLC (or licensed to us) and are protected by intellectual-property laws. You may not copy, sell, or use them without our written permission. All other trademarks (SWINT, Tobey Jack's, Meta, Shopify, Strava, and others) belong to their respective owners.
12 Acceptable use
You agree not to: break the law; cheat, defraud, or manipulate the rewards economy; upload false receipts or impersonate others; scrape, hack, overload, or disrupt the site; or use the services to harass anyone. We may suspend or terminate access for any violation.
13 Third-party services & platforms
We rely on third-party platforms including Meta (Facebook & Instagram), Shopify, Strava, and our messaging and infrastructure providers. Your use of those platforms is subject to their terms and policies. Our site and application are not endorsed, sponsored, or administered by Meta, Apple, Google, Strava, or Shopify, and we are not responsible for their services or availability.
14 Disclaimers
The site, the messages, the Taco Ride Stash, and all information we provide are offered "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that ride, weather, or trail information is accurate or complete, or that any result or reward will be achieved. Ride-status and weather content is informational only and is not a safety guarantee.
15 Limitation of liability
To the fullest extent permitted by law, Team Love Taco LLC, SWINT, Tobey Jack's, and their owners, members, volunteers, organizers, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, property damage, lost data, or lost profits, arising out of or related to the site, the messages, the rewards program, or your participation in the ride — whether based in contract, tort, or otherwise, and even if advised of the possibility. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this may not apply to you.
16 Indemnification
You agree to indemnify and hold harmless Team Love Taco LLC, SWINT, Tobey Jack's, and their owners, members, volunteers, and organizers from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the services, your content, your participation in the ride, or your violation of these Terms or any law.
17 Governing law & disputes
These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law rules. You agree that any dispute will be resolved exclusively in the state or federal courts located in Iowa, and you consent to their jurisdiction. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it.
18 Changes to these terms
We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, provide additional notice. Continuing to use the services after an update means you accept the revised Terms.
